TERMS & CONDITIONS

These general terms and conditions apply to every quotation, offer, agreement and delivery of goods on behalf of NAM music & coaching (Nadine). By using the website (including placing an order), the consumer decides on these general terms and conditions.

  1. “NAM music & coaching”, hereinafter referred to as “Nadine” means: the entrepreneur, the natural or legal person who offers products and/or services to customers.
  2. ‘Client’ or ‘customer’ means: other party of Nadine, who has concluded an agreement with her for the purchase of (online) product(s) or service(s).
  3. ‘Website’ means: www.nadinetermeer.com, including Nadine’s Instagram/Facebook pages and all future internet sites Nadine will have.

It is only possible to deviate from the provisions of these General Terms and Conditions if this has been agreed in writing; in which case the other provisions of these General Terms and Conditions will remain in full force.

Nadine has the right to change or supplement these General Terms and Conditions from time to time. The amended conditions will apply when they are published on the website.

A. Agreement and Terms

A1. An agreement is automatically concluded after acceptance of the customer’s order by Nadine. Nadine is entitled to refuse orders or to request additional information. If an order is not accepted, this will be communicated to the customer stating the reason.

A2. All sales are final. Services cannot be returned or refunded.

A3. Due to the preparation of (live) readings, retreats, workshops, masterclasses, speaker sessions and events, you can move your session free of charge 48 hours in advance. Within 48 hours this is only possible in a situation of force majeure. If you reschedule or forget your appointment too late, Nadine is unfortunately forced to charge the full cost of the session.

A4. In the event of cancellations due to circumstances from Nadine, every consumer will be offered the opportunity to reschedule the session or participate in another event. There is no guarantee of how long or short term that would be.

A5. The entrepreneur guarantees that the products and/or services comply with the agreement, the specifications stated in the offer, and the reasonable requirements of soundness and/or usability.

A6. If you are dissatisfied with the online training, events, coaching or support of Nadine, you must let me know by email as soon as possible. I will then receive a description of the complaint that is as clear as possible from you, so that I am able to respond and, if the complaint is justified, to rectify it. I cannot handle a complaint that is not clearly described. If your complaint is reported after 14 days, there is no longer any right to further consultation.

B. Offers

B1. If an offer has a limited period of validity or is subject to conditions, this will be explicitly stated in the offer.

B2. The offer is without obligation. The entrepreneur is entitled to change and adapt the offer at any time.

B3. The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to enable a proper assessment of the offer by the consumer.

B4. All images, specifications, data in the offer are indicative and cannot give rise to compensation or dissolution of the agreement.

B5. Part of an offer can be the recording of an online session. These are only shared with the relevant customer. At the request of the customer, it can also be decided not to record the sessions or to delete them after a certain time.

C. Price & Payment

C1. The prices stated in the offer of products or services include BTW (VAT).

C2. No rights can be derived from incorrect price indications. In the event of printing and typesetting errors, the entrepreneur is not obliged to deliver the product according to the incorrect price. The consumer is obliged to immediately report inaccuracies in payment details provided or stated to the entrepreneur.

C3. In the event of non-payment by the consumer, the entrepreneur has the right, subject to legal restrictions, to charge the reasonable costs made known to the consumer in advance.

D. Warranty & Liability

D1. Nadine cannot guarantee results. What works for me doesn’t have to work for you. The responsibility for this always lies with the consumer himself. I do share my knowledge and experience and it is my intention to connect consumers more with themselves.

D2. Nadine is never liable or obliged to pay any compensation to the consumer or third parties,  unless there is intent or gross negligence on the part of Nadine. Any resulting liability is always expressly limited to (I) the amount equal to the invoice value with regard to the product that caused the damage, or (II) the amount paid out in the relevant case by the liability insurance(s) taken out, plus the applicable deductible.

D3. Nadine is never liable for consequential damage, trading loss or (other) indirect damage. Nadine is never liable for damage (in any form whatsoever) that is the result of improper or incorrect use of a product, or when the consumer or third parties have made changes or used the purchased item for purposes for which it was not intended.

E. Force majeure

E1. If Nadine cannot fulfill its obligations towards the consumer due to force majeure, those obligations will be suspended for the duration of the force majeure. Nadine is not liable for any damage suffered or to be suffered by the consumer. In case of force majeure, Nadine has the right, at its own discretion, to suspend the execution of the customer’s order or to dissolve the agreement without judicial intervention, by notifying the customer in writing and without Nadine is obliged to pay any compensation, unless this would be unacceptable in the given circumstances according to standards of reasonableness and fairness.

E2. Force majeure is understood to mean any circumstance that does not depend on Nadine’s will, as a result of which the fulfillment of her obligations towards the consumer (in whole or in part) is prevented. These circumstances include: war, terrorism, power failures, fire, strikes, changed government measures (diseases), transport difficulties, malfunctions with the website.

F. Applicable Law

Only Dutch law applies to agreements between the entrepreneur and the consumer to which these general terms and conditions apply. Even if the consumer lives abroad.

G. Intellectual Property

G1. The content of this website is published by Nadine and protected by copyright. The design, all text, images, underlying source code and software (including applets) and all other material on this website are copyrighted by Nadine and may not be copied, modified or used in any other way without prior permission.

G2. Unless otherwise agreed, copyrights as well as all other intellectual property rights to these documents remain with Nadine.

G3. All content online and in sessions is for personal use only. It is not allowed to commercially sell, copy, adapt or include the content and acquired knowledge in your own (online) training, coaching, etc, unless I have given written permission for this.

H. Confidentiality

Both parties are obliged to maintain the confidentiality of all confidential information that they have obtained from each other or from another source in the context of their agreement. Information is considered confidential if this has been communicated by the other party or if this follows from the nature of the information.

I. Truthful

When you sign up for, subscribe to, or purchase a service or product through Nadine, you must provide only truthful and accurate information that is current and complete. Your entry of any information is your promise that any name, mailing address, email account and/or credit card information you provide to us is on record for you and/or that you are using such information with permission. You also promise that if you order or purchase products or services on behalf of a company or other entity, you have appropriate authority to bind that company to such transaction. If you use a pseudonym, nickname, false name or similar (where permitted), you agree that you will nevertheless provide accurate information to our processing company where necessary (e.g. your real name in connection with a credit card account) so that you can be billed for one-time or recurring charges.
